The Prosper Police Department annouced Wednesday that two people have been arrested on murder charges after a man died from a fatal dose of fentanyl in Prosper earlier this year.

Officers responded on Jan. 31 to the 100 block of West Sixth Street after a 911 call reported a possible overdose. They found the adult male Prosper resident dead inside the home, according to police. 

Investigators determined the man, who has not been publicly identified, died after ingesting a fatal dose of fentanyl, police said.

Jessica Shirey, 30, of Wylie, was identified as the person who provided the fentanyl that resulted in the man’s death, according to police. Detectives obtained an arrest warrant, and Shirey was taken into custody May 27 and booked into the Collin County jail on a murder charge.

As the investigation continued, detectives determined Shirey had obtained the fentanyl from Joey Jimenez, 32, of Dallas, police said. On June 11, Prosper detectives, with assistance from Dallas police, executed arrest and search warrants at Jimenez’s residence in Dallas.

Jimenez was taken into custody without incident and booked into the detention facility on a murder charge, police said.

“Our hearts remain with the victim’s family and loved ones as they continue to cope with this tragic loss,” Prosper interim Police Chief Ken Myers said in a written statement. “Fentanyl continues to devastate families and communities, and even a small amount can be deadly.”

Under Texas House Bill 6, which took effect in 2023, a person may be charged with murder if they knowingly manufacture or deliver fentanyl that results in another person’s death. The law does not require proof that the person intended to cause the death.

On June 10 Dallas County had its first successful prosecution which resulted in a sentence of 20 years in prison for murder under the same Texas statute.
